Suite ("the Platform"). By accessing or using this Platform, you agree to be bound by these Terms and
Conditions in accordance with the applicable laws of the Republic of Kenya, including the Computer Misuse
and Cybercrimes Act, 2018, the Data Protection Act, 2019, and the Kenyan Contract Act. If
you do not agree, discontinue use immediately.
1. Nature of Service
FlowOS Business Suite is a digital workflow and business operations support
platform. It enables users to organize tasks, manage internal processes, coordinate operational activities,
monitor performance metrics, and store business-related data.
The Platform functions strictly as a facilitation tool and does not provide financial custody, legal advice, or cybersecurity
guarantees, nor does it act as a fiduciary or trustee.
2. User Responsibility
Users retain full responsibility for all data uploaded, access credentials, internal operational decisions,
third-party integrations, and compliance with applicable laws. You acknowledge that system use involves
transmission of information across public networks.
3. Data Ownership
All data submitted remains the property of the User. The Platform acts solely as a processor and conduit of
operational information and does not assume control, custody, or ownership of such data.
4. Security & Access
While reasonable technical safeguards are implemented, the Platform operates
within a shared digital ecosystem and cannot guarantee absolute security. Users are responsible for password
protection, access control, device security, and internal user management.
Unauthorized access caused by credential compromise, user negligence, third-party systems, or external
cyber intrusion shall be deemed outside the operational control of the Platform.
5. Limitation of Liability
To the maximum extent permitted under Kenyan law, the Platform shall not be liable for data breaches,
unauthorized access, system infiltration, cyber-attacks, malicious third-party interference, loss of
business data, reputational impact, or financial loss resulting from external intrusion — where such events
arise from criminal acts, unlawful digital interference, force majeure cyber incidents, or third-party
infrastructure vulnerabilities. In such circumstances, responsibility shall lie with the offending actors in
accordance with the Computer Misuse and Cybercrimes Act, 2018.
6. Cybercrime Events
Where unauthorized access, hacking, or data compromise occurs, such acts shall be treated as criminal
interference under Kenyan law. The Platform shall not be deemed the originator, executor, or facilitator of
such unlawful acts. Legal liability shall attach to the perpetrators as defined under applicable statutes.
7. Service Availability
The Platform is provided on an "as available" basis. Downtime may occur due to infrastructure maintenance,
hosting provider issues, network disruptions, or external digital threats. No guarantee of uninterrupted
service is implied.
8. Indemnity
Users agree to indemnify and hold harmless the Platform against claims arising from misuse, negligent
access management, unlawful use, or regulatory breaches caused by user activity.
9. Third-Party Integrations
Use of external tools, APIs, or services remains at the User's discretion and risk. The Platform does not
assume liability for integration failures, external vulnerabilities, or data exposure through third-party
systems.
10. Governing Law
These Terms shall be governed by the laws of Kenya. Any dispute shall be subject to the jurisdiction of
Kenyan courts.
11. Acceptance
Continued use of the Platform constitutes acknowledgment that digital
environments carry inherent risks, absolute immunity from cyber intrusion is unattainable, and criminal acts
against digital systems remain the responsibility of their perpetrators.
